1. Acceptance of Terms
By accessing and using the services provided by Expedited Translation ("Company," "we," "us," or "our"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
These terms constitute a legally binding agreement between you and Expedited Translation. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting on our website.
2. Services Description
Expedited Translation provides professional translation services, including but not limited to:
- Document translation in multiple languages
- Certified and notarized translations
- Technical, legal, medical, and business translations
- Expedited translation services
- Quality assurance and proofreading
All services are subject to availability and acceptance by the Company. We reserve the right to refuse service to anyone for any reason at any time.
3. User Obligations
As a user of our services, you agree to:
- Provide accurate, complete, and current information
- Maintain the security of your account credentials
- Provide source documents that you have the legal right to translate
- Not use our services for any illegal or unauthorized purpose
- Not transmit any viruses, malware, or harmful code
- Comply with all applicable local, state, national, and international laws
- Pay all fees associated with your use of our services
4. Payment Terms
Pricing: All prices are quoted in U.S. Dollars (USD) and are subject to change without notice. Quotes are valid for 30 days from the date of issuance unless otherwise specified.
Payment Methods: We accept major credit cards, debit cards, and other payment methods as indicated on our website. Payment is processed through secure third-party payment processors.
Payment Terms: Payment is due upon receipt of invoice unless otherwise agreed in writing. For projects exceeding $1,000, we may require a 50% deposit before commencing work.
Late Payments: Accounts not paid within 30 days of invoice date may be subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.
Refunds: Refund requests must be submitted within 7 days of project delivery. Refunds are issued at our discretion and may be subject to a restocking fee of up to 25% of the project cost.
5. Intellectual Property Rights
Client Materials: You retain all rights to the source documents you provide. By submitting materials to us, you grant us a limited license to use, reproduce, and modify the materials solely for the purpose of providing translation services.
Translated Materials: Upon full payment, you receive all rights to the translated documents. However, we retain the right to use anonymized portions of translations for quality assurance, training, and marketing purposes.
Company Property: All content on our website, including text, graphics, logos, and software, is the property of Expedited Translation and is protected by U.S. and international copyright laws.
6. Confidentiality
We understand the sensitive nature of translation work and are committed to maintaining the confidentiality of your documents. All translators and staff members sign Non-Disclosure Agreements (NDAs).
We implement industry-standard security measures to protect your information. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
Upon request, we will execute a separate confidentiality agreement for projects requiring additional security measures.
7. Warranties and Disclaimers
Quality Assurance: We warrant that our translations will be performed by qualified professionals and will meet industry standards for accuracy and quality.
Disclaimer: EXCEPT AS EXPRESSLY PROVIDED HEREIN, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that our services will be uninterrupted, error-free, or completely secure. We are not responsible for errors resulting from unclear source documents, technical terminology, or cultural nuances.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPEDITED TRANSLATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim, or $500, whichever is less.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Termination
Either party may terminate the service agreement at any time with written notice. Upon termination:
- You remain responsible for payment of all services rendered up to the termination date
- We will return or destroy all client materials as requested
- All confidentiality obligations continue indefinitely
- Any provisions that by their nature should survive termination will continue in effect
10. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States and the State in which our principal office is located, without regard to its conflict of law provisions.
Dispute Resolution: Any dispute arising from these terms shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
Jurisdiction: You agree to submit to the personal jurisdiction of the courts located in our principal place of business for any actions not subject to arbitration.
